However, we do not guarantee uninterrupted service and are not liable for any losses or damages resulting from service interruptions, including but not limited to hardware failures, software issues, or network disruptions.

  9. Termination Either party may terminate the web hosting services upon written notice. We reserve the right to suspend or terminate your account without notice for any violation of our terms and conditions or if your use of the services poses a risk to our infrastructure or other users.

  10. Limitation of Liability To the fullest extent permitted by law, Sulana Host disclaims all warranties and shall not be liable for any direct, indirect, incidental, consequential, or exemplary damages arising from the use or inability to use our web hosting services.

  11. Governing Law and Jurisdiction These terms and conditions shall be governed by and construed in accordance with the laws of the United States of America. Any disputes arising from these terms and conditions or the use of our services shall be subject to the exclusive jurisdiction of the courts in the United States of America.

Response times may vary depending on the nature and urgency of the support request, but our aim is to provide timely assistance. c. Users can report issues or seek assistance by contacting our support team through the designated communication channels.

  14. Server Resource Usage a. Users are allocated server resources, including CPU, memory, and disk space, based on their selected hosting plan. b. Excessive resource usage that negatively impacts server performance or other users may result in necessary actions to mitigate the issue. c. Sulana Host reserves the right to monitor and manage resource usage to maintain fair and optimal hosting environment for all clients.

  15. Domain Name Registration a. If Sulana Host offers domain name registration services, specific terms and conditions related to domain name registration will apply. b. These terms include procedures for domain renewal, transfer, and dispute resolution in compliance with the respective domain registration authorities.

  16. Third-Party Services a. Sulana Host may offer additional services or integrate with third-party services for enhanced functionality. b. Users acknowledge that these third-party services may have their own terms and conditions, and users are responsible for complying with them when utilizing those services.

  17. Service Modifications and Updates a. Sulana Host reserves the right to modify or update the web hosting services, including changes to features, pricing, or terms and conditions. b. Users will be notified of any significant changes via email or through prominent announcements on the Sulana Host website. c. Users may have the option to accept the modifications or, if not acceptable, terminate their hosting services in accordance with the termination policy.

  18. Indemnification a. Users agree to indemnify and hold Sulana Host, its affiliates, and their respective employees and agents, harmless from any claims, losses, damages, liabilities, or expenses arising from their use of the web hosting services or any violation of the terms and conditions.

  19. Severability a. If any provision of these terms and conditions is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. b. The invalid or unenforceable provision shall be replaced with a valid and enforceable provision that most closely achieves the intended purpose of the original provision.

  20. Entire Agreement a. These terms and conditions, along with any incorporated policies or separate agreements, constitute the entire agreement between Sulana Host and the users. b. They supersede any prior agreements or understandings, whether written or oral, regarding the use of the web hosting services.

  21. Customer Data after Account Cancellation a. Upon cancellation of the hosting account, it is the customer’s responsibility to ensure the retrieval and backup of their data. b. Sulana Host may, at its sole discretion, retain the customer’s website data for a limited period after cancellation. However, the availability and duration of data retention cannot be guaranteed. c. Sulana Host reserves the right to handle customer data, including website files, databases, and emails, in accordance with applicable laws and industry standards. d. The management and potential usage of customer data after account cancellation will be handled based on Sulana Host’s internal policies and business needs. e. Customers are strongly encouraged to back up their data prior to canceling their account to safeguard against any unintended data loss.
  22. Account Transfer a. At Sulana Host, we understand the importance of seamless transitions, and we will make every effort to assist you in transferring your website from another hosting platform. b. Account transfers from other platforms are offered as a courtesy service, with the goal of ensuring a smooth migration process. c. However, please note that while we strive to facilitate these transfers, we cannot guarantee their feasibility or successful outcome. d. Each hosting company and platform operates differently, and some platforms may store data in incompatible or proprietary formats, making it challenging to migrate all account data effectively. e. Despite our best efforts, there may be instances where it is not possible to complete a transfer from your current host. f. The free transfer service provided by Sulana Host is available for a period of thirty (30) days from your sign-up date. g. Transfers requested beyond this thirty-day period may incur a charge, and we recommend reaching out to our Transfers department to receive a price quote. h. It is important to understand that Sulana Host will not be held liable for any data loss or missing files that may occur during the transfer process. i. Therefore, we strongly advise you to maintain backups of your data at all times, regardless of whether a transfer is being initiated.
  23. For the purposes of European Directive 95/46/EC, the General Data Protection Regulation 2016/679 (“GDPR”), and any applicable national implementing laws in your jurisdiction, and with respect to your subscribers’ or customers’ personal data, you acknowledge and agree that Sulana Host is the Processor (as defined in the GDPR) and you are the Controller (as defined in the GDPR). This acknowledgment applies to your storage of personal data through your use of our Services, only as permitted and subject to the terms of this Agreement.

    You further acknowledge and agree that, as the Controller, you are responsible for complying with all obligations of a data controller under applicable law, including but not limited to the GDPR. Sulana Host assumes the role of Processor and will process personal data on your behalf solely in accordance with your instructions as the Controller and as required to fulfill the services outlined in this Agreement.

  24. Billing and Payment Information

    Prepayment As a customer of Sulana Host, it is your responsibility to ensure that your payment information is kept up to date, and that all invoices are paid on time. You agree to make payment for the Services in advance of the time period during which such Services are provided. Payments received will be applied to the oldest outstanding invoice in your billing account, in accordance with applicable laws, rules, and regulations.

    Domain Payments For domain purchases, it is solely your responsibility to notify Sulana Host’s Billing department by contacting us at support@sulanahost.com or through our, Ticketing system, LiveChat service. Domain renewal notices are provided as a courtesy reminder, and Sulana Host is not responsible for any failure to renew a domain or for a failure to notify you about a domain’s renewal. Domain renewals will be billed and renewed thirty (30) days before the renewal date.

    Taxes The listed fees for the Services provided by Sulana Host do not include any applicable sales, use, revenue, excise, or other taxes imposed by any taxing authority. Any applicable taxes will be added to your invoice as a separate charge, which you are responsible for paying. All fees paid are non-refundable unless otherwise stated.

    Late Payment All invoices must be paid within ten (10) days of the invoice due date. Failure to pay an invoice within this timeframe may result in the suspension or termination of Services. Access to your account will only be restored upon receipt of the outstanding payment. In the event of non-payment, Sulana Host reserves the right to suspend or terminate your account and pursue the collection costs incurred, including arbitration and legal fees, as well as reasonable attorneys’ fees. Please note that new orders or packages will not be activated for customers who have an outstanding balance on their account.

    Fraud Misuse or fraudulent use of credit cards, charge cards, electronic funds transfers, electronic checks, or any other payment method is a violation of this Agreement. If Sulana Host determines, in its sole discretion, that such misuse or fraudulent use has occurred, we may report the incident to governmental and law enforcement authorities, credit reporting services, financial institutions, and/or credit card companies.

    Invoice Disputes You have ninety (90) days to dispute any charge or payment processed by Sulana Host. If you have any questions concerning a charge on your account, please reach out to our billing department at support@sulanahost.com or through ticketing system in client portal https://sulanahost.com/billing for assistance.

    Payment Card Industry Security Standard Disclaimer Sulana Host complies with the Payment Card Industry Security Standard (“PCI Standard”) in connection with the collection and processing of our customers’ data and billing information. However, we want to assure you that we do not store customer credit card information on our servers. Your payment information is securely processed by a third-party PCI-compliant payment gateway, ensuring the highest level of data security.

  25. Money-Back Guarantee, Cancellation, and Refund Policy

    Money-Back Guarantee At Sulana Host, we strive to ensure your satisfaction with our services. We offer a money-back guarantee for selected hosting plans within a specified time frame. Please note that the money-back guarantee does not apply to hosting plans with a monthly payment option. The guarantee is applicable to other payment terms as outlined in the plan details.

    If you have purchased an eligible hosting plan with a money-back guarantee, you may be entitled to a full refund of the shared, VPS, and reseller hosting fees paid (referred to as the “Money-Back Guarantee Refund”) if you cancel your account within the first thirty (30) days of the Initial Term (referred to as the “Money-Back Guarantee Period”). Requests for a Money-Back Guarantee Refund can be submitted by contacting our billing department at billing@sulanahost.com or through our client portal at sulanahost.com/billing. Please be aware that the Money-Back Guarantee Refund is subject to the terms and conditions described in this section and will be processed at our sole discretion. The Money-Back Guarantee Refund only applies to PayPal and credit card payments. Due to the associated costs of processing payments made by other methods, we regretfully cannot offer the Money-Back Guarantee Refund for those payment methods. Any refunds granted will be made at the sole discretion of Sulana Host.

    Non-refundable Products and Services Please note that certain products and services are non-refundable. These include dedicated servers, domain names, administrative fees, install fees for custom software, and specific add-on services such as SiteLock, SSL, Email.

    Sulana Host’s Discretion It is important to understand that the money-back guarantee is provided at our sole discretion. While we make every effort to accommodate refund requests, there may be circumstances where a refund is not granted. We reserve the right to evaluate refund requests on a case-by-case basis and determine their eligibility.

  26. Reactivation Fee

    If you choose to cancel your hosting account, please note that a reactivation fee of $10 USD will apply if you decide to reactivate it within 15 days of the cancellation date. This reactivation fee covers the administrative costs associated with processing the reactivation request and ensuring a smooth transition back to our hosting services.

    Important Considerations:

    1. Reactivation Period: The 15-day reactivation period begins from the date of account cancellation. Please keep this in mind if you intend to reinstate your hosting account.

    2. Avoid Unnecessary Cancellations: We encourage you to carefully evaluate your hosting needs to avoid unnecessary cancellations and subsequent reactivations. By maintaining continuous service, you can ensure uninterrupted access to your website and data.

  27. Suspended Accounts.
    SulanaHost reserves the right to terminate any account that has been in a suspended
    or deactivated state for thirty (30) days which will result in the loss of all data stored on the account.


  28. Shared and Reseller Hosting At Sulana Host, we expect our Shared and Reseller Hosting customers to utilize their hosting space in a manner that is necessary for hosting their public-facing website(s) and its core functionality. It is important to note that using shared and reseller hosting services as a cloud storage locker or for storing unrelated backups is strictly prohibited. Streaming video content is also not allowed in shared/reseller hosting environments. If you require storage for backups, cloud storage locker services, or video content streaming, we recommend considering our VPS hosting solutions. Our VPS and Dedicated Server product lines fully support these activities, as long as the content is legal and compliant with our policies.

    VPS Hosting For our VPS customers, we expect responsible usage and fair sharing of resources, particularly with regard to Disk I/O and CPU usage. Monitoring your resource usage and ensuring it falls within reasonable limits is essential. If you require dedicated resources and wish to maximize their usage, we suggest considering a dedicated server. Please reach out to our sales team for a discounted quote and further assistance.

    Prohibited Activities At Sulana Host, we strictly prohibit activities such as cryptocurrency mining, email spamming, brute force attacks, outbound DDoS attacks, CPU mining, Runescape, and traffic exchange on our platform. Engaging in any of these activities is not allowed and may result in account termination.
